Overview:
The Assistant Counsel serves as an attorney within Mercy's Legal Department. This role will have responsibility to provide subject matter expertise in one or more areas across a broad range of legal topics affecting Mercy's services and operations, including areas such as hospital and clinic operational support; health care provider legal guidance; health care risk management; clinical-related issues; employment-related issues, regulatory compliance and accreditation; medical staff and credentialing; contracting; healthcare policy and legal governance support. This position will be expected to carry out legal project work as directed, working both independently and within a team of other attorneys and paralegals. The Assistant Counsel provides legal analysis and recommendations for strategies and approaches in areas within their scope. The Assistant Counsel performs duties and responsibilities in a manner consistent with Mercy's mission, values and service standards.
Job Description:
- Provides legal counsel on healthcare entity (hospital, clinic, pharmacy, etc.) and provider operational issues.
- Provides legal advice on issues related to guardianship, consent, end-of-life care, patient safety concerns and challenging patient situations, often in time-sensitive circumstances.
- Provides legal advice on issues related to provider licensure, scope of practice, accreditation, medical staff, patient privacy, employment law, and development of service lines.
- Drafts and/or reviews legal documents and contracts relating to a variety of clinical and business-related situations.
- Provides legal counsel on regulatory and compliance issues and development of legal structures to achieve desired strategic and business objectives.
- Conducts legal research into applicable law and guidance, as well as interpretation of such laws and guidance.
- Anticipates and helps to mitigate legal risk that could affect the healthcare system, hospitals, clinics and providers.
- Stays abreast of current developments in health law and regulatory areas and determines impact on Mercy entities and services.
- Works collaboratively with in-house legal counsel and other specialty teams within the legal department, the Compliance Department, and other Ministry-wide departments.
- Participates in committees and task groups, such as Complex Patient Care Committees, and other duties as assigned.
- Participates as a member of the broader Legal Department and assists other attorneys and paralegals with legal support as well as department activities.
Qualifications:
Education: Juris Doctorate required.
Experience: Minimum three (3) years of experience as a practicing attorney with healthcare operational or health law experience in a law firm or healthcare organization. Health law certification and/or experience in healthcare risk management, healthcare compliance, and/or a clinical background is desirable.
Licensure: Membership in an applicable state Bar.
